Summary: Consistent with line of open records decisions holding that not all correspondence with private individuals qualifies for exclusion from public inspection under KRS 61.878(1)(a) or (i), Attorney General determines that comments submitted to school board after superintendent candidate forum were improperly withheld since they were submitted with the expectation that the board would rely on them in taking action and nothing in record on appeal suggested that the candor of the commenters was dependent on assurances of confidentiality. Privacy argument is unsupported by “weighing of competing interest” mode of decision articulated by Kentucky’s Supreme Court.
